1. Acceptance of Terms

By accessing or using SiteProof AI ("the Service"), operated by SiteProof AI ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to update these Terms at any time. We will notify registered users of material changes via email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

SiteProof AI is an automated analysis tool that scans websites to identify potential compliance issues related to the EU AI Act, GDPR, CCPA, and other regulations. The Service provides informational reports highlighting areas that may require attention.

The Service includes free scans, one-time reports, and subscription-based monitoring plans as described on our Pricing page. Features and availability may change over time.

3. User Accounts

Certain features of the Service require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information as necessary. You must notify us immediately of any unauthorized use of your account.

4. Free and Paid Plans

The free plan allows limited scanning without account creation. Free scan results are retained for 24 hours and then permanently deleted.

Paid plans (Single Report, Starter, and Pro) provide additional features as described on our Pricing page. Single Reports are one-time purchases and are non-refundable once the scan has been delivered. Subscription plans are billed monthly or annually and may be cancelled at any time, with access continuing until the end of the current billing period.

We reserve the right to modify pricing with 30 days' notice to existing subscribers. Price changes will not affect the current billing period.

5. Disclaimer — Not Legal Advice

THE SERVICE IS AN AUTOMATED ANALYSIS TOOL. RESULTS ARE INFORMATIONAL AND DO NOT CONSTITUTE LEGAL ADVICE.

SiteProof AI does not provide legal advice, legal representation, or legal certification of any kind. Our reports identify potential issues based on automated analysis, but they are not a substitute for professional legal counsel.

We strongly recommend consulting a qualified legal professional before making compliance decisions based on our reports. No attorney-client relationship is created by using the Service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITEPROOF AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. If you are using the free plan, our total liability shall not exceed $100.

We do not guarantee that the Service will identify all compliance issues, nor that addressing identified issues will result in full regulatory compliance. Compliance is a complex, ongoing process that depends on many factors beyond the scope of automated scanning.

7. Data Processing

When you submit a URL for scanning, we access publicly available content on that website. We do not store the full HTML of scanned pages. We retain only the URL, identified findings, and generated report data.

You represent that you have the right to scan the website you submit. You should not submit URLs for websites you do not own or have authorization to analyze. We reserve the right to refuse scanning requests at our discretion.

8. Acceptable Use

You agree not to:

• Use the Service to scan websites you do not own or have authorization to analyze
• Attempt to reverse-engineer, decompile, or extract the scanning algorithms or methodologies
• Use the Service in any way that violates applicable laws or regulations
• Resell, redistribute, or commercially exploit the Service or its reports without our written consent
• Overload or interfere with the Service's infrastructure through automated or excessive requests

9. Termination

You may terminate your account at any time by contacting us at support@siteproof.ai. We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated to registered users via email at least 30 days before taking effect. Non-material changes may be made at any time and will be reflected by updating the "Last updated" date.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
